PRE-PHOTOGRAPHY HOME PREPARATION & STYLING AGREEMENT
This Pre-Listing Photography Home Preparation and Styling Agreement ("Agreement") is entered into by and between Jentry Design Co, LLC, ("Prep Specialist"), located at 1 Chisholm Trail, Ste. 450, Round Rock, TX 78681, and the Client identified in this booking ("Client").
1. Selected Services & Fee Structure
- Base Home Prep Service (Standard Service Area): Flat fee covering up to 2 hours of pre-photography styling, organizing, and hiding daily and personal items from photo view.
- Travel Fee (Outside 25-Mile Radius): $30.00, applied if property address is located more than 25 miles from Company's primary business address.
- Accessory Rental Package (if selected): Billed monthly on a rolling 30-day basis, per the Rental Price Sheet.
- Cancellation Fee: $100.00, applied automatically if service is cancelled within 24 hours of scheduled time.
2. Booking, Scheduling & Cancellation
24-Hour Advance Notice Required: All job bookings, changes, or rescheduling requests must be submitted at least 24 hours prior to the scheduled appointment. If service is requested with less than 24 hours' notice, the Company does not guarantee availability. Client is responsible for ensuring the Company has property access at the scheduled start time; time spent waiting for access will deduct from total service time.
3. Payment Terms
Payment Due Before Service: Full payment must be received and cleared before services are rendered. Services will not commence without verified payment. A $100.00 exclusion/cancellation fee applies if services cannot be performed due to non-payment prior to arrival.
4. Property Movement, Decluttering & Pre-Existing Damage Disclaimer
Client grants the Company permission to handle, move, and temporarily store personal effects into closets, drawers, or non-photographed rooms. Prep Specialist is not responsible for lost, misplaced, or damaged personal items during standard decluttering. Client is required to secure all high-value items, jewelry, money, and sensitive financial documents prior to arrival. Company personnel will not move furniture exceeding 30 lbs, heavy appliances, or structural fixtures. Company is not responsible for pre-existing property damage. Company shall not be held liable for accidental damage except in cases of proven gross negligence, and total monetary liability shall not exceed the total dollar amount paid by Client for the service.
5. Accessory Rental Terms & Card on File Authorization
If accessory items are rented, they remain on-site for the agreed rental window. Rented items must remain inside the property, free from pet hair, smoke odor, stains, or physical damage. All Rental Items remain the sole property of Prep Specialist. Client authorizes the Company to keep a valid credit/debit card on file to cover any damages, non-returns, or late returns of rented accessories, charged at the replacement value listed on the Rental Price Sheet.
6. Client Election Options
Client may elect: to be present during the prep session, to authorize unattended access via lockbox/key code, to allow trash/hidden items to be consolidated in designated areas, to hold the Company harmless regarding pets, and to authorize the Company to coordinate directly with the scheduled listing photographer.
7. Governing Law and Venue
This Agreement shall be governed by the laws of the State of Texas. Venue for any legal dispute shall lie exclusively in Williamson County, Texas. The prevailing party shall be entitled to recover reasonable attorney's fees and costs.
8. Authority to Enter and Tenant Consent
Client warrants that they possess full legal authority (or written landlord/tenant consent) to allow Prep Specialist entry to the property, and agrees to hold harmless and indemnify Prep Specialist against any claims of trespass or privacy violations.
9. Waiver of DTPA Rights
Client expressly waives all rights under the Texas Deceptive Trade Practices-Consumer Protection Act. Prep Specialist makes no guarantees regarding home sale speed, property valuation, or photo engagement.
10. Entirety and Merger
This written Agreement represents the final agreement between the parties and may not be contradicted by evidence of prior, contemporaneous, or subsequent oral agreements.
11. Signatures & Authorization
By signing below, Client agrees to all terms, liability waivers, payment requirements, and rental policies outlined in this agreement.
